By using Ogma AI, you acknowledge that AI processing runs on-device by default using open weights models, with optional cloud providers you connect yourself. You own your prompts, data, and outputs. AI outputs are dynamic and should be verified for sensitive matters. Optional subscriptions are billed through Apple StoreKit.
1. Acceptance of Terms
By downloading, installing, accessing, or using Ogma AI: Offline AI Chat LLM ("the App"), provided by Abhinav Kumar, operating as Apex Creators ("we," "our," or "us"), you agree to be bound by these Terms and Conditions ("Terms") and the Apple Standard EULA. If you do not agree to these Terms, do not use the App.
2. Scope of Service & On-Device Architecture
Ogma AI is a privacy-first, on-device mobile AI assistant:
- Local Processing by Default: Inference, document processing, and vision analysis execute directly on your mobile device hardware. Cloud processing occurs only if you optionally connect a third-party provider with your own API key, or enable web search.
- No Server Retainage: Apex Creators does not host cloud servers to collect, store, or monitor your conversations.
3. AI Content Disclaimer & Model Licenses
- Stochastic AI Output: Large Language Models generate text stochastically. Apex Creators does not guarantee the factual accuracy, correctness, or completeness of generated content.
- Open Source Model Licenses: AI models downloaded via Hugging Face or imported by you are governed by their respective open-source licenses (e.g. Apache 2.0, MIT, Llama Community License).
- Professional & Medical Disclaimer: Content generated by the App is for informational, creative, and educational purposes only and must not be relied upon as certified legal, financial, or medical advice.
4. Acceptable Use & Prohibited Conduct
The App is not directed to children under 13, and you must be at least 13 years old (or the minimum age required in your country) to use the App. You agree to use Ogma AI strictly in compliance with applicable laws, Apple App Store Guidelines, and safety policies. You shall not use the App to:
- Generate or facilitate illegal harmful material (e.g., CSAM/CSAE or violent extremism).
- Facilitate hate speech, targeted harassment, extortion, or incitement of violence.
- Generate malicious exploits or software attacks.
- Infringe upon third-party intellectual property or copyright.
5. Ownership of Content
You retain 100% full ownership over all prompts, documents, photos, and generated AI responses produced on your device. Apex Creators asserts zero ownership rights over your local creations.
6. In-App Purchases & Subscriptions (StoreKit)
- Billing & Renewal: Payments for optional subscriptions are charged to your Apple ID upon purchase confirmation. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing cycle.
- Management & Cancellation: You can manage or cancel auto-renewal at any time in your Apple ID Account Settings.
- Restore Purchases: You may restore your previous purchases anytime in App Settings using the "Restore Purchases" button.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. IN NO EVENT SHALL APEX CREATORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE APP.
